Error in initializing, status: 40 using WiFi Shield & Max 32

i'm trying to run the WiFiTCPEchoServer 1.0 example sketch; however, i'm getting the "Error in initializing, status: 40" error. I've seen this error in a number of posts, but there doesn't seem to be a definite solution.

it seems as if this problem is common enough for an investigation and final solution. i'm using brand new boards with the latest software installation, and i was able to get the WifiScan sketch working with only a few hiccups.
